DADS Notice of Informal Public Meeting on Proposed Rules in Title 40 TAC for ALF, DAHS, HCSSA, ICF/IID, NF & PPECC

The Texas Department of Aging and Disability Services (DADS) stakeholders are invited to provide their input on proposed change of ownership (CHOW) rules June 17, 2016, from 1-5 p.m. at the HHSC office at 909 W. 45th St., Building II, in Austin. Comments also can be submitted in writing (see instructions below).

People with disabilities who need auxiliary aids or services to attend the meeting should call 512-438-4157, at least 2 business days before the meeting so appropriate arrangements can be made.

The proposed TAC changes will redefine what constitutes a CHOW by adding a new CHOW definition or amending the current definition (depending on the program type), as well as adding or redefining definitions for the following terms:

  • direct ownership interest,
  • disclosable ownership interest,
  • indirect ownership interest, and
  • license holder.

It also allows DADS to conduct a desk review in lieu of an on-site health survey after a license holder has a CHOW, if the license holder meets certain requirements.
