Dear Members, This week, HHSC announced via Provider Letter PL 19-02 that they will no longer maintain handbooks with Rules in them, referring instead to the Secretary of State (SOS) website where the online version of the Texas Administrative Code may be found. Downloadable, searchable copies of the Rules may be requested from the SOS, as described in the provider letter; HHSC will no longer provide this service. PL 19-02 states that HHSC will no longer maintain handbooks containing these Rules: Day Activity and Health Services Requirements, 40 TAC Chapter 98 Denial or Refusal of License, 26 TAC Chapter 560 Employee Misconduct Registry (EMR), 40 TAC Chapter 93 Intermediate Care Facilities for Individuals with an Intellectual Disability or Related Conditions, 40 TAC Chapter 90 Licensing Standards for Assisted Living Facilities, 40 TAC Chapter 92 Licensing Standards for Home and Community Support Services Agencies, 40 TAC Chapter 97 Medication Aides-Program Requirements, 26 TAC Chapter 557 Licensing Standards for Prescribed Pediatric Extended Care Centers, 40 TAC Chapter 15 Nursing Facility Administrators, 40 TAC Chapter 18 Nurse Aides, 26 TAC Chapter 556 Nursing Facility Requirements for Licensure and Medicaid Certification, 40 TAC Chapter 19 HHSC's remaining handbooks can be found on the Laws and Regulations section of their website here .
On June 29, 2017 Texas Health and Human Services released Information Letter No. 17-15 (IL 17-15), Removal of Service Codes for Habilitation and Residential Habilitation, This letter applies to providers who are contracted to provide the services in the following programs. Community Living Assistance and Support Services (CLASS) Case Management Agencies (CMAs) CLASS Direct Services Agencies (DSAs) Deaf Blind Multiple Disabilities (DBMD) Program Providers Financial Management Services Agencies (FMSAs) IL 17-15 states that effective July 10, 2017 , to prevent billing submissions for unavailable service codes the following service codes will be removed by HHS, service codes 10, 10A, and 10V associated with CLASS habilitation; and service codes 17 and 17V associated with DBMD residential habilitation

The Texas Department of Aging and Disability Services (DADS) published Provider Letter No. 16-22 — HCSSA Self-reports of Abuse, Neglect and Exploitation and Provider Investigation Report Form (DADS Form 3613) (Replaces PL 06-12). Home and Community Support Service Agencies (HCSSAs) must self-report all allegations of abuse, neglect and/or exploitation (ANE) to both the Texas Department of Family and Protective Services (DFPS) and the Texas Department of Aging and Disability Services (DADS) as required by Texas Health and Safety Code §142.018 and the Texas Administrative Code (TAC), Title 40, Part 1, Chapter 97, §97.249
